"Not Guilty" on both.

Niemuth Charges were dismissed until only 3 remained. He was found "Not
Guilty" on the ones relating to the outside dog. He was found "Guilty" on the
one count relating to the guinea pig housing conditions. Sentencing set for
June 12, 9am. Also, the subject of restitution will likely come up.

With all DUE respect to the parties responsible for prosecuting these cases, WHAT THE ^%&@????!!!!
Out of LITERALLY hundreds of photographs of approximately 500 animals, the majority of whom were in various stages of OBVIOUS abuse and/or neglect , why did the jury only see less than 20 photos?
Oh ya, that's because the State was not allowed to enter into evidence photos that didn't pertain to the specific animals in the measly handful of complaints rought against these people! So, here's the Million Dollar Question- WHY, oh WHY didn't the State file more charges against them? Did we not BEG you to do so?
I recently heard the ADA handling this case say that he'd been in courtrooms for over 20 years. How in the World did he believe the jury would ever get a clear picture of the goings-on at the Neimuth residence if the State wasn't allowed to enter into evidence the sheer NUMBER of animals that were under Neimuth's supposed "care"?
Is the District Attorney's office really SO busy that they don't have time to devote anything resembling adequate time to a case of this magnitude that has cost the State, local taxpayers, and private donors from all over the place what is surely somewhere in the hundreds of thousands of dollars? I wish someone would figure out that dollar amount, because I sure as heck would like to know! This is one of those times when you really needed to GET IT RIGHT the first time, or it's going to come back to haunt you. And mark my words- it will probably happen ALL over again!
I could go on and on about THAT, but I think I'll switch gears and address some whining from the Defense.
It is my personal opinion that "we" who are looking out for the welfare of the animals, at NO time did anything that was an attempt to interfere with JUSTICE. In fact, we're far less guilty of that than your average Defense attorney is during Closing Arguments. There is absolutely NOTHING wrong with constituents letting elected officials know how they feel about something- how else will they be able to effectively represent us? For the record, I was the one who first started publicly encouraging everyone to write letters. So, if anyone's to blame for that, it's me- a fact I'm quite proud of. I'm also quite proud of the fact that I put up this website and started collecting information for it and editorializing without any encouragement from anyone until after the fact. Last time I checked, we still had freedom of speech in this country.
Many of those who wrote were in the trenches of this thing- cleaning up messes that should never had been made. WE were the ones dealing with the parasites, the disgusting cages, the health problems, and the euthanasia of the ones who's suffering was so great we could not prolong it! And, I might add, most of us (if not all) were not drawing pay from the State- we did it out of the goodness of our hearts because we love and respect these animals. The animals are the REAL vicitims here, and who is better qualified to speak in their defense than WE are? If you think we're just going to take this lying down, you're wrong. We are feeling like victims ourselves, and we are pretty outraged about it.
So, what do we do now? I KNOW!! We have about a week before Clifford's case proceeds to sentencing, and Jennifer and Brian have a motion hearing. Let's WRITE MORE LETTERS! FYI, when you send one to Judge Huber, it also is distributed to all the relevent attorneys and the DA's office- so one letter to Judge Huber can get alot of mileage. Letters complaining to the DA's office about the negligent handling of this case are probably in order, don't ya'll think? I personally think it would be a good idea to drive that point home now, because we'll probably starting this all over again in a couple of years and we'd like for them to be better prepared next time. If you're feeling especially inspired, some Letters to the Editor would get alot of mileage as well.

The court orders sentence withheld and placed on probation
for 2 years on ea. count, concurrent. Conditions: Pay the costs of the action ea. count $88.00 Order for payment of restitution jaint and several with each other and co-defendants if ultimately convicted. Amount to be determined at a later hearing. Participate in an assessment / counseling as directed by probation agent and follow thru with treatment recommendaions arising from such assessment. |

currently receiving and medicine prescribed in a manner directed by physician. Direct defendant to perform 75 hours of CSW. Direct defendant surrender to the Humane Society all animals except for 2 dogs and 2 cats. - and they may only keep if spayed or neutered. Can not accept additional animals during term of probation. Must care for the animals. If the agent observes any maltreatment - they shall be forfeited. Defendant may also keep (1) ferret. This little guy is currently staying with me. He and his brother were in pretty rough shape when they came out of the Niemuths'. His brother got better soon after, but this little guy ended up going through sub Q fluids and 5 rounds of antibiotics, and still was failing to thrive. I brought him home where he could get more one-on-one. I had to hand feed him when he first got here. His appetite had dwindled to practically nothing. He is finally growing and thriving again, but it's been a long, rough road....and he still weighs only about 1/3 of what he should. His brother has already found a new home, and we will probably adopt this little guy. As you can see, he likes it on our bed! |
